  15. Phil Cartwright has put together a guide for users of Med/Octamed.
  16. The disk was entitled Octatutor and was released as Shareware. It
  17. was on offer to yearly subscribers in Scanner 13.
  18. Ray Burt-Frost who founded Amiganuts and claims the copyright to the
  19. Octamed program heard about the disk and isn't too happy.
  20. Below is the letter he sent to Phil Cartwright and the reply from Phil
  21. follows on.

  44.  It has been brought to our attention that you have released a
  45. diskette titled the OctaMED tutor into the public domain and that you
  46. are also claiming copyright of same.
  47. Allthough  we are awaiting the delivery of this disk, we feel it only
  48. fair to warn you at this early stage that the name OctoMED is
  49. copyrighted and is owned by this company and any text/manuals on paper
  50. or diskette relating to the name or program itself may not be
  51. distributed without our prior permission which, if given, includes
  52. legal documentation from RBF Software stating this fact for the users
  53. protection and of course our own.

  55. If you have, as reported to us,sent out such a diskette to the public
  56. domain distributers then you must act at once to avoid any unwanted
  57. legal action being taken by RBF Software, by recalling them
  58. immediately whilst making it perfectly clear to those  companies you
  59. have sent it to that it must not be offered for sale at this time.
  60. Kindly send us your own copy of the diskette including a covering
  61. letter officialy requesting permission to release the program.

  63. We understand that you are claiming copyright and asking for a fee if
  64. the end user finds the program usefull, this is also very illegal as
  65. the instructions, no matter how presented, are relating to a copyright
  66. program.

  68. We shall await reports from all the main public domain networks, as
  69. well as BBS services and the major magazines, if they do not report
  70. that you have notified them of it's withdrawal, further legal action
  71. will be instigated.

  73. We are sorry about this harsh treatment as had you contacted us first,
  74. this could oh so easily have been avoided.

  76. Please ensure that you do not release any further instructions related
  77. to our copyrighted program unless authorised to do so.

  80. officialy have items released, then in future please send them to the
  81. Med Users Group and if we approve them,they can go out as pd.

  98. Dear Sir,
  99.          I have today read your recent threatening narrative
  100. concerning my computer program "Octatutor", and have placed a copy of
  101. your letter in the hands of my solicitor. Before I instruct same, I
  102. believe it may be in our mutual interest for me to inform you of one
  103. or two facts. I do not, and have not, in any way, actual or implied,
  104. claimed copyright of the program "Octamed". The article that I have
  105. written in no way infringes any copyright.
  106. I quote the following as evidence:
  107. Section 1 of the Copyright, Designs and Patents Act 1988 (Commencement
  108. No.1) Order 1989 (SI 1989) No. 186 provides that:
  109. 1. Copyright is a property right which subsists in accordance with
  110. this Part in the following descriptions of work-
  111.     (a) original literary, dramatic, musical or artistic works,
  112.     (b) sound recordings, films, broadcasts or cable programmes, and
  113.     (c) the typographical arrangement of published editions.
  114.  
  115. Literary, dramatic, musical or artistic works are only protected under
  116. the 1988 Act if they are original (1988 Act,s.1 (1)(a)). The program
  117. "Octamed" itself is a copy of the original "Soundtracker" program and
  118. is therefore not protected. [This concept of "originality" is
  119. mentioned in the 1911 and 1956 Copyright Acts, and has been tested on
  120. numerous occasions through the courts.]
  121. It also follows, in strict interpretation of the Act, that whereas
  122. unauthorised adaptation of the program code would infringe copyright,
  123. (should copyright exist), there would be no copyright restriction on
  124. adaptation of the various artistic works, (Documents, Instructions or
  125. texts), provided it did not amount to copying of same. [Again, this
  126. has been through the courts, and is nothing new. See, for example,
  127. Victoria Park Racing & Recreation Grounds Co. Ltd v Taylor (1937) 58
  128. CLR 479; Football League Ltd v Littlewoods Pools Ltd [1959] Ch. 637;
  129. Ladbrook (Football) Ltd v William Hill (Football) [1964] 1 WLR 273.]

  131. Furthermore, copies of the program "MED" and early versions of
  132. "Octamed" have been released into the public domain and discussion
  133. documents and informative articles have been published worldwide on
  134. both of the programs. Thus it would appear that "Octamed" and the
  135. accompanying literature are public domain programs, whichever version
  136. you use, because the minor differences that exist between one version
  137. and another do not constitute an "original" work.

  139. Also, in the introduction of the tutor (if you had read it), quote:
  140. "....it [Octamed] is not a PD or "freeware" program ....you should buy
  141. the program from Amiganuts. .....The PD program MED 3.2 ....can be
  142. used in conjunction with this tutor."
  143.  
  144. You will note that with these lines I have attempted, to some extent,
  145. to protect the program from unauthorised distribution of the "later
  146. versions", and expressed the opinion to potential purchasers that the
  147. program author should be rewarded for his efforts. This could hardly
  148. be to your detriment, as it appears that you have a monopoly of the
  149. aforementioned "later versions".
  150.  
  151. Surely, it is a good thing to be creating interest in the Octamed
  152. program using the tutor. Your bullying tactics will not be allowed to
  153. continue, and the resulting publicity will, I am sure, do nothing but
  154. harm for your corporate image.

  156. However, in order that you may become better informed, I enclose a
  157. copy of the Octatutor for your perusal. I look forward to hearing your
  158. comments.

  195. Many thanks for your letter dated 22nd July, received today.
  196.  
  197. We are sorry if the letter,(as is obvious), has upset you, however as
  198. we pointed out to you, we were acting on a phone call left on our
  199. ansaphone, it gave your address and said that you were offering the
  200. OctaMED tutorial to end users stating that it was copyright and
  201. suggesting a £5.00 fee.
  202.  
  203. As stated in our letter to you, we had not seen your disk and were
  204. awaiting a chance to see same.
  205. The letter, informing you of the fact that OctaMED 'IS' a copyrighted
  206. program was not just for our protection but yours as well.
  207. As it turns out, having now seen the much appreciated copy of the
  208. disk, you are quite right and there is nothing in it that we could
  209. possibly find objectionable and having gone through it we do in fact
  210. like the way you have presented the program.

  212. We apolagise if the letter, as you state, appeared to be threatening,
  213. it was not meant to appear as such, we wrote to you in good will so
  214. that any copyright was stopped before any unwanted,(on our part),
  215. nastiness occured, thus saving anyone getting hurt.

  217. If you have taken the wrong view of the letter, there is, of course,
  218. nothing we can do about this,as it was not meant to be taken the way
  219. you have read it's contents.
  220.  
  221. As to your unwarranted (as with all things in this jolly old world,it
  222. works both ways), counterthreat of solicitors (good God) , we leave
  223. this matter to you, but as yourself in all honesty how you would at
  224. first react if you owned something and were told by a third party that
  225. the copyright was being infringed.
  226. Would you not attempt a freindly aproach, (well we THOUGHT it was!),
  227. writing to the person concerned to try and stop any infringement
  228. before it began?

  230. On a MUCH, much lighter note, IF you are intending to write a version
  231. of your very well presented octamed tutorial for the new V5, please
  232. let us know and providing you don't ask for anything more than perhaps
  233. a couple of disks filled with mods as a thank you, we can arrange for
  234. distribution throughout the globe, via the OctaMED users group.
